Power of Attorney
An important part of all estate plans is a Financial Power of Attorney. This document allows a trusted family member or friend to be named as your “agent” who will be allowed to take care of your finances when you no longer can due to incapacity or illness. The Financial Power of Attorney is comprehensive allowing your “agent” to act on your behalf in a variety of financial settings until you are well.
Due to our more-complex world, even the telephone company will not speak to us without knowing our social security number and date of birth. With a Financial Power of Attorney your named agent can access any accounts in your name, and apply for benefits on your behalf, when you are ill or incapacitated. A Financial Power of Attorney is vital for a person with dementia or in assisted-living.
I can create powers of attorney so that they do not go into effect unless a certain event that you choose occurs -- like incapacity (as determined by two doctors), or incompetence (as determined by a Court). This way you do not have to worry about anyone meddling with your finances as long as you can still handle them.
